Director III-
Under the direction of the Deputy Associate Commissioner (DAC) for Regional Operations in Health Care Regulation (HCR), and with extensive latitude for the use of initiative and independent judgment, the Health Facility Compliance Director III, performs advanced (senior-level) managerial work overseeing the daily operations and activities of regional operation leadership and teams responsible for conducting state and federal surveys, complaint investigations, and other compliance related activities in acute-care provider settings, including abortion facilities, ambulatory surgical centers, birthing centers, chemical dependency treatment facilities, community mental health centers, comprehensive outpatient rehabilitation facilities, end stage renal disease facilities, federally qualified health centers, freestanding emergency medical care facilities, general and special hospitals, private psychiatric hospitals, crisis stabilization units, laboratories (clinical laboratory improvement amendments) limited services rural hospitals, narcotic treatment programs, outpatient physical therapy/outpatient speech pathology, portable x-ray services, rural health clinics, special care facilities, as well as oversight of professional licensees including licensed chemical dependency counselors and licensed sexual offender treatment providers.
Key Responsibilities include:
Regional leadership and oversight – directs and supports regional directors to ensure consistent oversight, adherence to policies, and alignment with compliance objectives across all regions
Policy implementation – ensures proper knowledge and application of state and federal regulations, survey protocols, and complaint investigation processes
Cross-functional collaboration – works closely with other HCR managers and teams to promote coordination and integration of compliance activities across the program
Strategic alignment – partners with the DAC and AC to establish compliance goals, priorities, and initiatives that reflect leadership vision and direction
Budget Oversight – assist the DAC in developing and monitoring annual budgets, including state general revenue and federal CMS and CLIA allocations
CMS Knowledge and Reporting – maintains expert knowledge of CMS regulations and requirements, oversees preparation and submission of quarterly and annual CMS reports to ensure timeliness, and compliance
Operational Excellence – plans, assigns, and supervises work of regional directors; monitors performance and ensures accountability for compliance outcomes
Collaborative Oversight – works closely with other Regulatory Service Division programs (Complaint and Incident Intake, Enforcement, Child Care Regulation, Long Term Care Regulation) to ensure processes are efficient and promote consistent communication
Essential Job Functions (EJFs):
The Director of Health Facility Compliance plans, assigns, and supervises the work of the health facility compliance Regional Directors located across Texas.
Manage and provide oversight to staff to ensure that the daily state and federal workload activities, such as scheduling compliance activities across the state, are prioritized and conducted according to state and federal policies and procedures; and in coordination with other state or federal teams as necessary.
Provide technical guidance to health care regulation staff when reviewing statement of deficiency reports and plans of correction for acceptability. This position assists the DAC and AC for health care regulation in developing and evaluating budget requests and monitors the annual CMS and CLIA budgets and expenditures. Oversees the preparation of management and productivity workload reports.
Assists in the timely completion of open record requests, customer service/media/legislative requests and assignments, evaluation of cases for potential state escalated enforcement, reviewing cases for possible recommendation to CMS certification termination, and ensuring referrals of professional staff to licensing boards are well documented and appropriate.
Actively participates in required bill analysis assignments during legislative session. Represents health facility compliance at meetings, hearings, trials, conferences, etc., as appropriate.
Works collaboratively with other state agency departments in order to represent health facility compliance where regulatory participation is required.
Communicates on a complex level with others (internally or externally) to provide, exchange, or verify information, answers inquiries, addresses issues, or resolve problems or complaints.
Manages staffing and expenditures for the regional office.
Develops and monitors performance standards for assigned area.
Ensures all state and federal performance standards are met.
Attends work on a regular and predictable schedule in accordance with agency leave policy and performs other duties as assigned.
Knowledge, Skills and Abilities (KSAs):
Knowledge of state and federal regulatory standards and procedures, survey techniques and principles for programs regulated by Health Care Regulation.
Proficient in the use of computers and agency/facility software, including Microsoft Word, Excel, PowerPoint, Access, Outlook, and SharePoint.
Strong verbal and written communication skills, including the ability to clearly, effectively, and professionally communicate expectations, directions, constructive feedback, and all other information relevant to the position.
Ability to recruit and retain qualified staff at all levels to carry out the required regulatory functions in the regional offices.
Ability to establish and maintain effective working relationships with managers, team members, external stakeholders, and others.
Ability to analyze complex sets of data and information and make appropriate decisions regarding compliance of a provider with prescribed licensure and certification requirements.
Ability to analyze and evaluate current processes and program performance; identify problems, program inefficiencies, and areas for improvement; and collaborate and develop strategic plans and goals.
Ability to complete multiple tasks with competing deadlines.
Registrations, Licensure Requirements or Certifications:
None.
Initial Screening Criteria:
Bachelor's degree from an accredited college or university with a major in public administration, health care administration, hospital administration, business administration, education, psychology, social work, sociology, nursing, medicine, or a discipline related to developmental disabilities and/or gerontology, plus three (3) years of work experience in an administrative, management, and/or productivity improvement role in the operation of a large human services delivery agency.
Experience in a Texas state agency regulatory program may be substituted on a year for year basis for the required education, with a maximum substitution of two years.
Minimum four years full time experience in program and personnel management and administration.
Minimum 2 years' experience in health facility regulation and/or health care administration in a program area regulated by HHSC Regulatory Services Division.
The following are preferred:
Experience working within the Texas Health and Human Services Commission (HHSC) or in a healthcare facility regulated by the state of Texas.
Expertise in healthcare regulation and survey processes, including knowledge of federal and state regulations governing healthcare facilities (e.g., CMS regulations, State Operations Manual).
Direct experience conducting facility inspections, enforcing compliance, or overseeing regulatory activities.
